In Field Pro Privacy Policy

This privacy policy explains how In Field Pro LLC (“IFP”, or “we”, “us”, “our”) collect, use and share personal information (“Personal Information”) which we collect via the services offered on our In Field Pro mobile app (collectively, the “Platform”).

We take our privacy obligations seriously, and use the Personal Information provided to us only as specified in this privacy policy. Please read this privacy policy carefully so that you can make an informed decision about using the Platform. If you do not agree to this privacy policy, you may not use the Platform. By registering an account to use the Platform, and by using the Platform, you are agreeing to this privacy policy and consent to our collection, use and disclosure of Personal Information as described in this privacy policy. Please note we make the Platform available through specific user applications that are created for, and administrated by, our In Field Pro clients (each, a “Client Application”). For more information, see Sections 5 and 6, below.

1. WHAT INFORMATION DOES THIS PRIVACY POLICY COVER?

This privacy policy covers the Personal Information that is collected on or through the Platform, and from which an individual may be personally identified. Personal Information includes, without limitation, an individual’s name, email, street address, telephone number, geolocation information, image, gender, schedules, appointments, polling data, and other such information provided by the individual.

INFORMATION PROVIDED BY CLIENTS AND PEERS

We receive Personal Information about third party individuals (“Peers”) from the In Field Pro client administering the Client Application. If a Peer has received a text message through our services, such Peer’s information was uploaded to the Platform by the In Field Pro client. We will treat all such Personal Information in accordance with this privacy policy. We may also collect polling information from clients or directly from Peers.

INFORMATION DISCLOSED THROUGH USE OF THE PLATFORM

The Platform allows In Field Pro clients to transmit text messages (“Content”) via the Platform. We may contract with In Field Pro clients to help facilitate the transmission or sharing of Content through the Platform. Other people may be able to view Content once it has been transmitted through, or uploaded to, the Platform, and may use or share it with third parties. We have limited control over who views Content while it is being transmitted through the Platform and no control over who views Content after it has been transmitted through or uploaded to the Platform, or any third party uses that are made of Content. This privacy policy will not apply to third party uses of any Content after it is transmitted through the Platform. We may also publish your name with your Content, and we may use your Content, or any portion of it, for advertising, marketing, publicity, and promotional activities. 2. COLLECTION OF NON-PERSONAL INFORMATION

We use “cookies” to store session information. We use both session ID cookies and persistent cookies. A session ID cookie expires when you close your browser. We use Session Cookies to track your account login status. This cookie is only ever transmitted over HTTPS. A persistent cookie remains on your hard drive for an extended period of time. We use persistent cookies to determine from where you were referred to our website, as well as the last user ID that you used to log in. We may set and access our cookies on your computer; cookies are required to use the Services. You can remove persistent cookies by following directions provided in your Internet browser’s “help” directory. If you reject cookies, you may still use the Platform, but your ability to use some areas of our site, may be limited.

We gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.

We use this information, which does not identify individual users, to analyze trends, administer the site, track visitors’ and users’ movements around the website and gather other information about our user base as a whole.

We link this automatically-collected data to Personal Information. IP addresses are tied to Personal Information to better gauge our visitors’ and users’ needs and provide specific information to best serve them.

We may partner with a third party ad network to manage our advertising on other sites. Our ad network partner may use cookies and web beacons to collect non-personally identifiable information about your activities on this and other websites to provide you targeted advertising based upon your interests.

3. CHILDREN’S PERSONAL INFORMATION

We do not knowingly collect, use, maintain or disclose Personal Information of children younger than 16 years of age (each “Child” and, collectively “Children”).

4. HOW WE USE INFORMATION

We will use information collected through the Platform to provide our services and to provide you with information you request or that we believe you would be interested in receiving.

In addition, we use Personal Information to improve, expand, and promote the Platform and our services; provide support and notifications and develop new features; provide you with personalized advertising and marketing; personalize the Platform experience for you; detect, prevent, mitigate, and investigate fraudulent or illegal activities; and enforce our Terms of Service.

5. COLLECTION OF INFORMATION BY YOU

In order to use the Services, you must have adopted, and keep in effect and practice throughout the provision of Services, a privacy policy that is no less protective of Personal Information than this Privacy Policy. You must provide us with a copy of your privacy policy, and promptly provide any updates to the same as may be enacted or adopted from time to time.

6. WITH WHOM DO WE SHARE YOUR PERSONAL DATA?

THIRD PARTIES PROVIDING SERVICES ON OUR BEHALF

We may from time to time engage third parties to perform functions on our behalf; examples include hosting or operating our Platform, sending e-mail communications, sending text messages through our Platform, and data analysis. We may share Personal Information with third parties in order for them to provide content or otherwise perform services for us. We only provide the information necessary for those service providers to provide the services and subject to their agreement to treat such information in accordance with this privacy policy.

BUSINESS TRANSFERS

We may share Personal Information with other entities affiliated with us for internal reasons, primarily for business and operational purposes. IFP, or any of its assets, including the Platform, may be sold, or other transactions may occur in which your Personal Information is one of the business assets of the transaction. In such case, your Personal Information may be transferred.

LEGAL PROTECTIONS AND LAW ENFORCEMENT

We may transfer and disclose information, including Peers’ Personal Information, usage information and device identifier (including IP address), to third parties to comply with a legal obligation; when we believe in good faith that the law requires it; at the request of governmental authorities conducting an investigation; to verify or enforce the Platform’s Terms of Use or other applicable policies; to respond to an emergency; or otherwise to protect the rights, property, safety, or security of third parties, visitors to this Platform or the public. Pursuant to valid requests by law enforcement agencies, we may also use device identifiers to identify users, and may do so in cooperation with copyright owners, Internet service providers, wireless service providers or law enforcement agencies, in our discretion. Such disclosures may be carried out without notice to you.

7. ACCESSING OR UPDATING YOUR INFORMATION AND OPTING OUT FROM COMMUNICATIONS

You have the right to access Personal Information you provided and held by us and, if necessary, have it amended or deleted. 8. SECURITY

We incorporate commercially reasonable technical, organizational and administrative safeguards to help protect and secure Personal Information. However, no electronic data transmission or storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information you transmit to us, and your use of the Platform is at your own risk.

9. NOTIFICATION OF CHANGES AND YOUR ACCEPTANCE OF THE PRIVACY POLICY; PRIVACY QUESTIONS

We reserve the right to change, modify or add to this privacy policy at any time, and to apply any such change, modification or addition to Personal Information that we have already collected. We may provide you with notice of a change, modification or addition by posting a notice or a revised privacy policy via the Services. You agree to review the Services from time to time to review the current policy and any changes, modifications or additions. In the event we make a material change to how we use or disclose Personal Information, we will provide you with notice.

10. RETENTION AND DELETION OF PERSONAL INFORMATION

We will retain Personal Information you provide for so long as necessary to enable your use of the Platform and to comply with applicable legal and regulatory requirements. You may choose to delete information from your account or delete your account entirely. However, please note that messages sent by you to others or by us on your behalf or direction on or through the Platform may be retained by us or by the recipient of such messages, and we may need to retain certain information for our business records.

11. GOVERNING LAW

This privacy policy (and any claim, dispute or matter arising under or in connection with it or its enforceability) shall be governed by and construed in accordance with the laws of the State of Delaware.
